Chatsworth DUI Checkpoint on 3/25/2011

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> The Los Angeles Police Department is now holding sobriety checkpoints beyond just the city limits of L.A. This week, law enforcers with the police department will be traveling to the city of Chatsworth to try and prevent DUI crimes. LAPD announced in a press release this week that a DUI checkpoint has been scheduled tonight at the following time and location.

Friday March 25: Topanga Canyon Boulevard between Devonshire Street and Chatsworth Street, between 8:00 p.m. and 2:00 a.m.

Chatsworth drivers should be on the lookout for a marked roadblock and be aware of the legal rights that they have when proceeding through the DUI checkpoint. We've discussed the legal rights of motorists in a blog post titled "Los Angeles DUI Attorneys Analyze Sobriety Checkpoints."

]]> When Chatsworth drivers proceed through the marked checkpoint, law enforcers will not only be checking drivers for signs of impairment, but they will also look to see if motorists have proper licensing. According to Time's Techland Blog, four U.S. senators are trying to get Apple, Google, and Research in Motion to stop selling these types of apps because they say that these programs encourage drunk driving.

Checkpointer by Ace Baron and Fuzz Alert Pro by Fuzz Alert are just a couple of applications that are known for posting information about DUI checkpoints in Los Angeles and metro areas across the country, including the location of such roadblocks. DUI lawyers argue, however, that these smartphone apps do not encourage drunk driving and that they even promote traffic safety by informing drivers that they shouldn't get behind the wheel while impaired. Just because an app lets drivers become aware of a DUI checkpoint location, doesn't mean that buzzed driving is encouraged.

CNN recently reported that BlackBerry maker Research in Motion has already agreed to pull smartphone apps that help users avoid DUI checkpoints. We’ll see if Apple and Google follow in RIM’s footsteps.

The Los Angeles Times reported that it was once common for the black tea drink to have more than 0.5 percent alcohol, which is the limit for non-alcoholic drinks in the United States.

This left Kombucha tea manufacturers with two options: either change their formula so that the drink's alcohol content would be reduced, or label the product as an alcoholic beverage. It looks like the company GT Kombucha has decided to do both.

]]> Kombucha tea is apparently making a quiet return to the market with a whole new style. GT Kombucha is making one new Kombucha product that will have its alcohol content within the .5 percent limit, but the company is also launching an over-age-21 Kombucha drink that remains slightly alcoholic. While this new branding may seem simple, some say that the new variety has the potential to create a great deal of confusion among consumers.

Some parents may now not want their children to have any Kombucha tea product. Drivers may accidently drink the alcoholic type of Kombucha tea and get themselves into an accident or even arrested on suspicion of DUI.

Obviously, it would take a significant number of Kombucha tea drinks to get drunk. Yet Los Angeles drivers may still want to be on the safe side and avoid getting behind the wheel after the consumption of Kombucha tea. CDC Finds That Ignition Interlocks Prevent Repeat DUI Offenses

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> Authorities in California have been trying various enforcement tactics to prevent repeat DUI offenders from driving under the influence, but perhaps the best way to stop the repeat offense is through the installation of ignition interlock devices.

According to Reuters, a study conducted by the Community Guide branch of the Centers for Disease Control and Prevention (CDC) found that re-arrest rates for alcohol-impaired driving decrease by 67 percent after the ignition interlocks are installed, when compared to drivers with only suspended licenses and no ignition interlock device in their vehicle.

]]> The CDC study could push California lawmakers to pass a new law that requires all offenders with a DUI conviction in the state to install an ignition interlock device in their vehicle. As of July 1, 2010, ignition interlocks are required upon DUI conviction in only four California counties through Assembly Bill 91.

The California Department of Motor Vehicles states that through the AB 91 pilot program, individuals convicted for first and repeat driving under the influence offenses in Alameda, Los Angeles, Sacramento, and Tulare Counties must install a certified ignition interlock device in all vehicles that they operate. The pilot program will continue through December 31, 2015.

DUI crashes resulted in nearly 11,000 deaths in the United States in 2009. Some people may argue that a large portion of these deaths could have been prevented if there was more widespread use of ignition interlock devices in the vehicles of DUI offenders. Anthony Louis Fragoso Pleads Guilty to Drunk Driving in Hospital

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> Most impaired driving suspects will have to appear in court when they've been charged with DUI-related offenses. However, in some extreme cases, the defendant can go through court procedures in an alternative location.

The Los Angeles Daily Breeze reports that 21-year-old Anthony Louis Fragoso recently pleaded guilty to charges of vehicular manslaughter with gross negligence from a hospital bed, as he was seriously injured in the car crash that killed two others on the 91 Freeway in Anaheim.

]]> Bail was set at $150,000 in Fragoso’s case, but he will likely remain in his hospital bed at Western Medical Center in Santa Ana until he is able to recover. Fragoso has his next court date scheduled at the North Justice Center in Fullerton on February 22. We’ll see if he is actually able to make it to the courtroom the next time around.

Tests done after the fatal crash last month showed that Fragoso had a blood-alcohol level of .20 percent, which is significantly above California’s legal limit of .08 percent. While driving his 1996 Mercedes-Benz on January 19, Fragoso drove in the wrong direction on the Riverside Freeway and crashed into another vehicle in a head-on collision. The driver of the other vehicle, Alan Reyes, and his passenger Vanessa Cease reportedly died at the scene of the crash.

In addition to dealing with vehicular manslaughter charges, prosecutors say that they plan to add the DUI allegations to the criminal complaint as well. Hence, it looks like Fragoso will be facing a long jail sentence if he is ever released from the hospital.

LAPD Changes DUI Checkpoint Rules For Impounded Vehicles

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> The Los Angeles Police Department regularly conducts DUI checkpoints, but the purpose of these checkpoints is not just to arrest people for driving under the influence; officers are also looking to arrest motorists who are driving without a valid license. Previous protocols called for LAPD officers to impound a vehicle whenever the driver did not have a valid license or was suspected of driving under the influence.

However, The Republic reports that the rules for vehicle impoundment are changing at DUI checkpoints due to concerns that undocumented immigrants were being wrongfully targeted in such operations. Under new the guidelines, Los Angeles police officers will attempt to contact the registered owner of a stopped vehicle if the owner of the vehicle is a licensed driver who can respond to the checkpoint within a reasonable period.

]]> Even with the new guidelines, unlicensed drivers will still be cited and DUI suspects will still have their vehicles impounded. Once a vehicle is impounded, law enforcement agencies usually require that the vehicle remain locked up for a minimum of 30 days. Vehicle owners will then have to pay expensive fees to get their car released from the impound lot.

Some critics of the new policy say that the new guidelines threaten traffic safety and don’t do enough to discourage people from breaking the law. Yet immigration activists say that the old rules disproportionately targeted undocumented immigrants, who are not able to obtain licenses legally in most states. Perhaps the new DUI checkpoint rules will create more fairness on the roads.

Danae Miller Arrested For DUI After 15 Traffic Citations

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> Danae Miller has been accused of killing a bicyclist while she was driving under the influence in Newport Beach, but some California residents are wondering why this 22-year-old woman was able to drive with a valid license in the first place. According to The Daily Pilot, Miller has received 15 different citations for various traffic violations since 2005.

The bulk of Miller's traffic citations were reportedly in her first year of driving. Now at age 22, Miller can face serious criminal charges that include DUI and vehicular manslaughter. The fatal accident took place last week on San Joaquin Hills Road near Spyglass Road.

]]> In California, a driver's license can be suspended if drivers accumulate four points on their record in 12 months, six points in 24 months or eight points in 36 months. A person is eligible to attend traffic school for certain violations once every 18 months, which can remove points from a driver's record.

Between July 2005 and January 2008, Miller was convicted of eight traffic violations that each counted as one point on her driving record. DMV officials stated that because this particular driver attended traffic school, certain points did not count against her. Hence, she was able to keep her driver's license. After 2008, the time between Miller's tickets never added up to enough points for a license suspension.

If Danae Miller is convicted of DUI or vehicular manslaughter, she may finally be forced to get off of the road for a designated period of time. However, she still needs to be represented by an attorney so that she can receive proper defense in the case. Consequences for a DUI, even one that is not as serious as this, can be long-lasting and effect insurance rates and even a future job hunt due to negative information on a background check.

Los Angeles Memorial Coliseum Could Lose Alcohol License

The Los Angeles Times reports that the penalties for such a violation can range from a warning letter or fine to the suspension or revocation of an alcohol license.

The allegations against the Los Angeles Memorial Coliseum come after The California Department of Alcoholic Beverage Control found through an investigation that the Coliseum allegedly allowed consumption and sales of alcohol outside of its licensed area. Multiple violations apparently occurred last year at the Electric Daisy Carnival rave. The neighboring Sports Arena is also facing similar accusations. ]]> Sales certainly have the potential to decline if the Coliseum and Sports Arena are unable to sell alcohol, but perhaps we’ll see less DUI arrests and drunk driving accidents on the Los Angeles roads if this were to happen.

People under the age of 21 in California can face DUI charges if they’re found to have any amount of alcohol in their system, so it’s especially important for the underage individuals to be careful of consuming alcohol before driving.

People under the age of 21 can also be charged with minor in possession (MIP) if they are found to be in possession of alcohol, regardless of whether or not they are drinking. Under California law, first time offenders convicted of MIP may have their driver’s license suspended for a year.

Christina Aguilera and Matthew Rutler Arrested After Drunk Driving Incident

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> Pop star Christina Aguilera and her boyfriend Matthew Rutler were both arrested in West Hollywood after Los Angeles County sheriff's deputies noticed Rutler breaking the rules of the road on the Sunset Strip early Tuesday morning. According to The Los Angeles Times, Rutler was caught "burning rubber" and speeding in his vehicle.

Deputies believed that Rutler was driving under the influence after conducting field sobriety tests and proceeded to arrest him. Meanwhile, singer Christina Aguilera was riding in the passenger seat and was described as "very intoxicated" by authorities on Tuesday.

]]> Law enforcers arrested Aguilera on suspicion of public drunkenness, but it looks like the singer won’t have much to worry about in this case. Public drunkenness is typically a misdemeanor crime the state of California, but the Los Angeles County Sheriff’s Department says that criminal charges will not be filed against Aguilera because the circumstances simply do not merit charges. The arrest, however, will go on Aguilera’s record.

Christina Aguilera was simply taken into police custody because she was apparently so impaired that she wasn’t able to care for her own safety. There’s no evidence that laws were broken in this situation. However, it looks like her boyfriend isn’t going to be so lucky in his case.

Matthew Rutler was released on $30,000 bail and it’s likely that he’ll be charged with DUI. A driving under the influence conviction in Los Angeles County can lead to penalties that include jail time, probation, fines, community service, alcohol education classes, and the installation of an ignition interlock device. Other consequences can include an increase in insurance rates and issues with future background checks that could affect a person’s ability to get a job.

Alleged Drunk Driver Crashers Through Watts Healthcare Corp.

The most ironic part of the story is that the suspect allegedly crashed her SUV into a sober living facility while allegedly driving under the influence.

Perhaps this can be a valuable lesson to the people staying in the sober-living house, as they can still learn about the dangers of drunk driving through the real-life experience. Yet last weekend's crash is certainly no laughing matter for all the parties involved.

]]> Authorities have not yet released the DUI suspect's name, but news reports say that the car slammed into Watts Healthcare Corp. Inc. on S. Figueroa Street and that five people suffered from minor injuries as a result of the accident.

What type of criminal penalties will the suspect be facing if convicted of felony DUI? According to FindLaw, a person will typically face a harsher punishment for drunk driving when an accident results in an injury to another person. The offense is most often punishable with time in state prison, along with probation, fines, license suspension and mandatory alcohol education classes.

As for those people from the Los Angeles sober-living house, many of them may now be a bit traumatized by the dramatic crash through the house. Mark Skillingberg Sentenced to One Year for Vehicular Manslaughter

type="html" xml:lang="en" xml:base="http://losangelesduiblog.com/"> A movie and television music editor was sentenced last week to just one year in jail and five years of probation after killing a 72-year-old man in a 2009 drunk driving accident, despite the victim's family pushing for a harsher punishment. The Los Angeles Times reports that the sentencing of editor Mark Skillingberg came after a no contest plea to a charge of vehicular manslaughter without gross negligence.

Skillingberg's accident took place when he was reportedly driving at about 20 miles above the posted speed limit with a blood alcohol level that was twice the legal limit in California. If Skillingberg completes his probation without incident, then the felony conviction will eventually be reduced to a misdemeanor and expunged from his record.

]]> So how exactly was the defendant able to get away with not going to prison and likely avoid a felony that sticks to the permanent record? To begin with, Skillingberg had no criminal record prior to the 2009 drunk driving accident. The sentence in this case was part of a plea agreement, in which the district attorney's office said there "would likely reach the same result" if the case were to go to trial. A probation report also concluded that Skillingberg was not a danger to the community and that he would be able to learn from his experience.

Judge Katherine Mader noted that Skillingberg is not going unpunished for the crime, but she did express sympathy for the victim's family. If Skillingberg violates the terms of his probation, he will be sentenced to much stiffer penalties.

LAPD states that DUI checkpoints are regularly conducted in the community in order to reduce the incident of injuries, death, and property damage associated with drunk driving. The 77th Division alone apparently experienced 129 DUI-related traffic collisions last year. Hence, the need for more DUI enforcement.

The state of California actually has strict guidelines and restrictions for law enforcers when it comes to how sobriety checkpoints are conducted.

Rolonda Watts Arrested For DUI in Hollywood

According to the National Retail Federation (NRF), 52 percent of adults say that they will be celebrating St. Patrick's Day this year, which is up from the 45.2 percent of adults who said that they would celebrate the holiday in 2010.

How will people be spending their St. Patrick's Day this year? Most people say that they'll be wearing the color green. NRF found that 19.1 percent of Americans will be attending a private party on March 17 and that another 31.2 percent of adults will be attending a party in a bar or restaurant.
