
Danae Miller has been accused of killing a bicyclist while she was driving under the influence in Newport Beach, but some California residents are wondering why this 22-year-old woman was able to drive with a valid license in the first place. According to The Daily Pilot, Miller has received 15 different citations for various traffic violations since 2005.
The bulk of Miller's traffic citations were reportedly in her first year of driving. Now at age 22, Miller can face serious criminal charges that include DUI and vehicular manslaughter. The fatal accident took place last week on San Joaquin Hills Road near Spyglass Road.
In California, a driver's license can be suspended if drivers accumulate four points on their record in 12 months, six points in 24 months or eight points in 36 months. A person is eligible to attend traffic school for certain violations once every 18 months, which can remove points from a driver's record.
Between July 2005 and January 2008, Miller was convicted of eight traffic violations that each counted as one point on her driving record. DMV officials stated that because this particular driver attended traffic school, certain points did not count against her. Hence, she was able to keep her driver's license. After 2008, the time between Miller's tickets never added up to enough points for a license suspension.
If Danae Miller is convicted of DUI or vehicular manslaughter, she may finally be forced to get off of the road for a designated period of time. However, she still needs to be represented by an attorney so that she can receive proper defense in the case. Consequences for a DUI, even one that is not as serious as this, can be long-lasting and effect insurance rates and even a future job hunt due to negative information on a background check.
